At its fifty-second session, the General Assembly decided to convene the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court, to be held in Rome, Italy, from 15 June to 17 July 1998, "to finalize and adopt a convention on the establishment of an international criminal court".
STATEMENT BY AMBASSADOR ELYAKIM RUBINSTEIN ATTORNEY GENERAL OF ISRAEL HEAD OF ISRAELI DELEGATION

Mr. President,
Let me open by extending to you our warm wishes for your success and the success of this Conference. We would also like to express our appreciation to the Government of Italy for hosting the Conference.
Some fifteen hundred years ago, the sages of the Talmud, the classic Jewish code, sought to distil the moral essence of the Bible into seven fundamental laws, as the basis of a universal morality. Six of these so-called Noachide laws, applying to all mankind, were elementary moral prohibitions: not to murder, not to steal, and so on. But to these negative commandments was added one positive injunction: the commandment to establish courts of justice.
Enforcement is essential, lest criminals evade their punishment.
Today, on the verge of a new millennium, we, representatives of the nations of the world, gather in a effort to fulfill that injunction to establish courts of justice and to see that crimes do not go unpunished.
As we do so, we cannot help but have in our minds the unspeakable Nazi crimes of the Holocaust, in which a third of the Jewish people was exterminated, which first prompted the General Assembly of the United Nations to ask the ILC to consider the establishment of permanent criminal court fifty years ago, and the heinous atrocities that the world has continued to witness in the decades since then. It is no historic coincidence that Israel, emerging from the ashes of the Holocaust, was established fifty years ago.
The last few years, following significant global changes, have seen far more progress towards the establishment of the Court than the decades which preceded them. For this great credit is due to Mr. Adriaan Bos for his skillful stewardship of the Committee and to the dedicated members of the Bureau. We regret his being unable to participate at this time, and wish him a speedy recovery.
However, notwithstanding the recent progress, even a brief glance at the draft Statute that lies before this Conference, and the plethora of options and brackets that it contains, indicates quite how much work is left to be done. The positions of my delegation concerning, the detailed issues left to be resolved have been made clear throughout the preparatory conferences and intersessional meetings, and we will continue to take an active - and I hope constructive - role in the discussions ahead of us.
Needless to day, we wholeheartedly support the sacred mission of prosecuting war criminals. No honest human being can question the necessity of bringing to justice perpetrators of genocide, crimes against humanity and war crimes, including gender crimes and violence against children. However, the involvement of political bodies in the decision-making process presents built-in problematics. I would venture to propose two general principles that may help us in trying to bridge gaps and find a workable balance to enable the conclusion of the draft Statute.
The first is that the Court must retain a clear focus on the most heinous of international crimes and the non-availability of national criminal justice. We should keep in mind that the Court, in the language of the Preamble to the Statute, is to be: "complementary to the national criminal justice systems in cases where such trial procedures may not be available or effective---. In other words, our goal is not so much the effectiveness of the Court, as the effectiveness of the international legal system as a whole. Where effective national procedures are available, the establishment of alternative jurisdiction is not only unnecessary, but it may even diminish their effectiveness.
The second principle is the need to exercise utmost caution in trying to ensure the objectivity and impartiality of the Court. This is crucial not only in order to ensure the effectiveness of the Court, but also in order to encourage the community of states to accept this new organ as an integral and valuable part of the international scene.
Inevitably, the fact that complaints are to be filed by states creates the possibility that the investigative procedure may be abused for political ends. It may be impossible to eliminate this danger entirely, but it is the hope of my delegation that it may be reduced by establishing more stringent criteria for the filing of a complaint than are currently proposed by the ILC draft.
By the same token, while we support the strong standing and independent position of the prosecutor, we feel that this independence should not be put in jeopardy by giving the prosecutor the power to initiate ex officio investigations, which may invite undue and improper influence.
In the context of the dangers of politicisation, I would also observe that my delegation is not persuaded that the conditions are yet ripe for the inclusion of the crime of aggression within the Statute of the Court. The clear lack of consensus with regard to an acceptable definition of the crime, together with the political sensitivity inherent in any attempt to reach such a definition give us cause to fear that it would be too easily manipulated for political ends. This fear, I would add, is borne out by some of the proposed definitions contained in the draft before us.
These comments stem from a single concern: to ensure, to the utmost possible, that the noble ideal which is the drive behind our efforts, does not turn into yet another arena of international politics. We have enough such arenas; we are here striving for a very different goal.
As regards the issue of terrorism, it is a menace to mankind which is of great concern to us, being among its victims and among the nations which have combatted it. In considering whether the Court should play a role in the fight against terrorism, my delegation feels that the Conference must find the correct balance between recognizing terrorism as an international crime, and focusing on the most practical and effective means of cooperation in bringing international terrorists to justice.
In conclusion, let me express the earnest hope of my delegation that the work of this Conference will be practical and productive; the task is difficult and sometimes one may feel that we are trying to square the circle. It is our hope that the great torch carried here will shed fight on the tough issues that may seem like an uphill battle. It is our wholehearted wish that, in the face of the appalling crimes that we continue to witness, this Conference will help us to channel our outrage to justice, to break the cycle of impunity, and, in the words of the prophet Amos, to "let justice well up like a fountain".

The Noachide Code (also known as the "Sheva Mitzvos Bnei Noach," or the Seven Laws of Noah) is a set of basic social, moral, and legal principles, described in the Babylonian Talmud as binding on all human societies. In effect, it is a universal code of law prescribed by the Torah of Israel for humanity. Since the Code is the most explicit statement in Jewish jurisprudence regarding the normative condition of non-Jewish society, it represents an essential framework for discussion of the Jewish perspective on the appropriate elements of non-Jewish legal systems.
Despite the obvious significance of the Noachide Code, both as an academic inquiry for students of Jewish civilization and as a source of universal moral values, the Code remains an obscure topic.
In previous generations, the precarious or outright hostile conditions in which world Jewry survived precluded any public discussion of the Code. In our generation, however, discussion of the Code both in print and on the internet has increased noticeably. The last two decades have witnessed a dramatic increase in the number of both rabbinical and academic writings as well as the new phenomenon of books and web pages written for a lay or popular readership.
This latter category is particularly noteworthy because it corresponds to an unprecedented historical development: the emergence of a population of gentiles seeking to conduct their lives according to the Noachide Code. In the context of an ever-increasing number of such individuals, the absence of practical directives for the Noachides becomes a serious issue.
In 1991, the Benjamin N. Cardozo School of Law, of Yeshiva University, hosted a symposium on religious law and legal pluralism. This event included presentations by some of the world's foremost experts on the Noachide Code, later published in Volume 12 of the Cardozo Law Review.
Now, the Chevras Etz Chaim/Tree of Life Society and the Leonard and Bea Diener Institute of Jewish Law present a symposium designed to promote further scholarly investigation of the Noachide Code. This forum will focus exclusively on the Code and will feature many of the foremost scholars and experts from around the world..

The Universal Noachaide Code As stated in the Bible (Genesis 9:1-7) and Talmud, the Universal Noachide code is a guide to general ethics and also international relations which would remedy these inadequacies:
The recognition of a Universal, Supra-national code would replace national sovereignty.
The fulfillment of the Code would be undressed to be a collective responsibility.
The Universal Code would operate between individuals as well as between states. Therefore it would apply equally to internal affairs, and under its rule, stateless and foreign individuals would be protected.
Such a world government could take the form of a World Federation, a loose bi-polar system, or a wider balance of national groups.
The seven principles of the Universal Noachaide Code are presented below, combined with an application of these principles to a world governing body.

"The Noachide Code contains no creed, no theoretic statement about the nature of G-d, belief in which is the condition of salvation. It consists of solely of such articles of practical morality as are an essential condition of civilized life. This is reflected in the use made of it from the tenth to the seventeenth century. In the hands of the Purists, it became one of the main elements in the foundation of the edifice of Universal International Law." (Leon Roth)

The United Nations Organization is striving to fulfill many of the principles of the Universal Code. The UN could well develop into an agency for implementing the Noachide Code, and bringing it to universal acceptance, as the basis for true harmonious International Relations.
World government based on the Universal Code of G-d could be introduced and maintained by a minimum use of force. Since the discipline and education of such a lifestyle is basically pacifist, little or no force would be required to maintain it.
What better approach for universal peace?

Unfortunately, this is one of those "based in some truth" Internet misrepresentations, such as those that flourished in years past with regard to Madeline Murray O'Hare. The Resolution which you referenced is similar to many the Congress passes to honor various Americans on occasions such as their birthdays.
In fact, the Noahide laws are those laws in the Old Testament, which many scholars, including William Blackstone, the primary expounder on the Common Law in the days before the American Revolution, believe are the basis for the Western jurisprudence enacted into our Constitution.
These Noahide laws are thought by these scholars to be legal tenants for every nation and civilization--not just the nation of Israel. The laws in the Old Testament have been divided by scholars who study these things into those laws just meant for Israel (i.e. laws regarding eating pork, etc.) and those laws that are more universal (such as laws against murder and theft).
So there is no cause for alarm on 2 levels: (1) The Resolution process is a common occurence, not the enacting of a law; and (2) the Noahide laws are not Jewish laws.

I am sorry that we are not able to help you. Resolutions honoring many folks are regularly passed by the Congress with no intention of affecting any other Americans. The laws in the Old Testament that are recognized by scholars as the Noahide laws are not referenced by that word in the Scriptures. Noahide is merely the word that Bible and legal scholars use to distinquish them from the Mosaic laws, which are those laws introduced by God through Moses specifically for the nation of Israel and not for all nations. The Noahide laws were pre-Mosaic laws (hence the use of the word Noah, who was the father of many nations--not just Israel) although some laws are classified as both. Similarly, the Holy Scriptures never use the exact word "Trinity" to describe the "Father, Son and Holy Spirit" but the concept is there.
I am sure that this is not the answer you wanted to hear, however, the good news for you is that this is not something you need to worry about.

One of the seven laws of Noah (the laws that are encumbent on all mankind) is prohibiting the consumption of a limb of a living creature. And while this is of course not the same as severing a limb I think the practice would fall under this prohibition as these seven laws of Noah are better reckoned as categories of commandments than single commandments."

Paul is a thorn in the side of Noahidism
1. In his books The Mythmaker and Paul and Hellenism , Talmudic scholar Hyam Maccoby proposed a theory that Paul was actually a Gentile raised in an environment influenced by the popular Hellenistic mystery religions centered on dying and resurrected savior deities, who later converted to Judaism, hoping to become a Pharisee scholar. He found work in Jerusalem as a police officer of the Sadducee High Priest, who was at that time a de facto Roman quisling in Jerusalem. Paul's work persecuting the enemies of the High Priest led to an internal conflict in his mind, which manifested itself while he was travelling to Damascus on a covert mission. Maccoby believes that Paul's revelation was thus actually a resolution of his divided self; Paul subsequently fused the mystery religions, Judaism and the Passion of Jesus into an entirely new belief, centered on the death of Jesus as a mystical atoning sacrifice. Maccoby considers Paul's claims to a Jewish background and Pharisaic education to be false, claiming that a number of passages in Paul's writings betray his ignorance of the Jewish Law. Maccoby also contends that Paul invented many of the key concepts of the Christian religion, and that Gospels and other later Christian documents were written to reflect Paul's views rather than the authentic life and teaching of Jesus. Maccoby questions Paul's integrity as well:

Emden's view was that Saul of Tarsus was a devout and learned Pharisee, who (turning away from his early Shammaite views) came to believe in salvation for the gentiles and under the guiding authority of the very learned and devout Simon Kepha (i.e., Saint Peter) set about refining a noahide religion for the gentiles based around the Jehoshua (Jesus) movement...
- He did however insist that any man born of a Jewish woman be circumcised (for example Timothy whom he himself carried out the ceremony upon) and live under the law. In recent years perhaps the most exemplary developers of Emden's view are the orthodox Rabbi Harvey Falk and Pamela Eisenbaum [1]. In this view, Paul is seen as a rabbi who understood the ruling that although it would be forbidden to a Jew, (believing in the divine through the name of another) would be permissible for a gentile despite the noahide ban on idolatry.
- This is further backed up by Paul in his first letter to the Romans when he compliments them on their religion. Again when he spoke to Greeks about a divinity in their pantheon called "The Unknown God", it can be understood that he was trying to de-paganise their native religions for the sake of their own salvation.

But truly even according to the writers of the Gospels, a Jew is not permitted to leave his Torah, for Paul wrote in his letter to the Galatians (Gal. 5) "I, Paul, say to you that if you receive circumcision, the Messiah will do you no good at all. You can take it from me that every man who receives circumcision is under obligation to keep the entire Torah." Again because of this he admonished in a letter to the Corinthians (1 Cor. 7) that the circumcised should not remove the marks of circumcision, nor should the uncircumcised circumcise themselves.
This will also solve the apparent contradictions in the Nazarenes own statements. Christian scholars have assumed from certain passages in the Gospels that he wished to give a new Torah to take the place of the Torah of Moses. How could he then have said explicitly that he comes only to fulfill it? But it is as I have said earlier--that the writers of the Gospels never meant to say that the Nazarene came to abolish Judaism, but only that he came to establish a religion for the Gentiles from that time onward. Nor was it new, but actually ancient; they being the Seven Commandments of the Sons of Noah, which were forgotten. The Apostles of the Nazarene then established them anew. However, those born as Jews, or circumcised as converts to Judaism (Ex. 12:49; one law shall be to him that is home-born, and unto the stranger) are obligated to observe all commandments of the Torah without exception.

WHAT IS SHUVOO?
WHAT IS SHUVOO?
Shuvoo means "return". In fact, it is an active verb form meaning "(you) return". It has particular emphasis in a passage written by the Prophet Malachi: "Ever since the days of your fathers, you've turned away from My statutes and haven't observed them. Return (shuvoo) to Me and I will return (ashuvah) to you, says the G-d of Hosts." (Malachi 3:7, JPS Tanach)
This website is about returning to G-d … the G-d of Israel. It is about returning in truth and clarity, looking back to the foundation of faith for all nations of the world, the Noahide Commandments, and forward to the Torah given by G-d to Moses - the most complete revelation of G-d that can exist in this world until the World to Come.
The Noahide Commandments are seven basic laws binding upon ALL humanity. Six of these laws were given to Adam, and the seventh law was given to Noach after the Flood. Keeping these seven basic laws would allow the 70 nations of the world to live righteous lives and inherit a share in the World to Come. Jews also keep the seven laws within their observance of the Torah. The Noahide Laws are the "measuring stick" by which any religion can be evaluated - if it contradicts these basic laws, it is necessarily flawed.
With the giving of the Torah, G-d established a Covenant People chosen, formed and called out by Him to be His witnesses:
"And Moses went up to G-d. The L-RD called to him from the mountain, saying, 'Thus shall you say to the house of Jacob and declare to the children of Israel: You have seen what I did to the Egyptians, how I bore you on eagles' wings and brought you to Me. Now then, if you will obey Me faithfully and keep My covenant, you shall be My treasured possession among all the peoples. Indeed, all the earth is Mine, but you shall be to Me a kingdom of priests and a holy nation.' These are the words that you shall speak to the children of Israel." (Ex. 19:3-6)
"All the nations assemble as one, the peoples gather. Who among them declared this, foretold to us the things that have happened? Let them produce their witnesses and be vindicated, that men hearing them, may say, 'It is true!' My witnesses are you - declares the L-RD - My servant, whom I have chosen. To the end that you may take thought, and believe in Me, and understand that I am He; before Me no god was formed and after Me none shall exist. (Isaiah 43:9-10)
As the appointed witnesses of G-d, the children of Israel were given a special responsibility:
"For He has said: It is too little that you should be My servant in that I raise up the tribes of Jacob and restore the survivors of Israel: I will also make you a light of nations, that My salvation may reach the ends of the earth." (Isaiah 49:6)
Until the destruction of the Second Temple, Judaism actively reached out to the nations of the world, teaching Bnei Noach (non-Jews who understood and adhered to the Noahide Laws). For the past 2000 years, the Jewish nation has been scattered to the four corners of the earth, living under the dominion of foreign governments in nations that had their own religion(s). It would not have been well received by the leaders of these religions and governments if Jews had encouraged their people to consider the Noahide Commandments as a way of life. Simply being a Jew in these nations without being persecuted was usually difficult enough. As a result, the Sages of Judaism cautioned against active outreach to the nations of the world for it would surely have been seen as a religious and political threat. However, a nation was reborn in 1948, and Jews have been returning to their G-d-given land ever since. In Israel, a Jew can fulfill the commandments of the Torah freely, including the command to be "a light to the nations". "For instruction shall come forth from Zion and the word of the L-RD from Jerusalem." (Isaiah 2:3) This is happening in our days. With the advent of Internet, never before in history has so much Torah been accessible to the nations of the world. The Shuvoo website has been created to act upon the responsibility for Jews to be a light to the nations.
The passage of time has layered darkness, deception, distortion and confusion upon both the Noahide Laws and the Torah. Neither one is truly understood by the nations of our present time. Tragically, the Torah is not understood by many Jews, especially Jews who have found their way to other religions through assimilation or proselytizing. Shuvoo has been created to illuminate the ancient paths of return (shuvoo) to the foundations established by G-d in order that all mankind might merit the revelation of Moshiach and the Redemption of the world.

The Noachide Faith in Masonic Sources The Old Charges - A Return to our Root The Chevalier Ramsay used to declare: ìFreemasonry is indeed the resurrection of the Noachide religion, that of the Patriarch Noah, that religion prior to any dogma, which allows us to go beyond the differences and oppositions of the various faithsî. [as quoted on the site of the Grand Lodge of France] ![]() Andersonís Constitutions of 1738 could very well contain the seedbed of our religious faith and practice as Freemasons. While most masons officially claim that Freemasonry is NOT a religion, it is certainly religious so long as one has a proper understanding of the term and maintains a distinction between what religion is, and what religious means. Freemasonry opens its doors to men of every creed so long as they believe in a Supreme Deity, to whom all men are held accountable for the maintenance of certain basic universal laws, defined by Dr. Anderson as the moral law. In his 1738 [2nd] edition of the Constitutions he gave this moral law a name. The name applied by Anderson to this "moral law" was Noachide. (also variously spelled; Noahide, Noachite, NoachidÊ, Noachida). The entry NoachidÊ, found in the ENCYCLOPDIA OF FREEMASONRY1 states the following: "The descendants of Noah. A term applied to Freemasons on the theory, derived from the 'legend of the craft,' that Noah was the father and founder of the Masonic system of theology. And hence the Freemasons claim to be his descendants, because in times past they preserved the pure principles of his religion amid the corruptions of surrounding faiths. Dr. Anderson first used the word in this sense in the second edition of the Book of Constitutions: 'A Mason is obliged by his tenure to observe the moral law as a true Noachida.' But he was not the inventor of the term, for it occurs in a letter sent by the Grand Lodge of Calcutta in 1735, which letter is preserved among the Rawlinson MSS. in the Bodleian Library, Oxford. (See Ars Quartuor Coronatorum, xi., 35.) In The History of Freemasonry - Its Legendary Origins, Mackey devotes an entire chapter to the Masonic connection with the figure of Noah and so covers the topic more thoroughly. I haven't read Frye, but I had a few thoughts to share anyway. The change from monarchy to democracy as paradigm of society has made a difficulty in the theological realm, as Mr. Billington rightly puts it.
In the Jewish liturgy we say "Avinu Malkeinu", "Our Father Our King". The metaphor is of an absolute monarch who has the power of life and death over his subjects as well as a father to whom we owe our existence and upbringing.
The concept is of course relevant to the Christian tradition as well.
In our day the breakdown of the family has rendered the father-concept problematic as well, the male with whom the child spends every other weekend or something like that. I wonder if democracy is not similarly flawed and totalitarianism is not merely a modern sickness of trying and failing to return to the primeval father-king.
For those of us who see the ultimate eschatology (Messiah) in such a return, we have to examine the nature of a polity in which a spiritually-endowed, prophetically-consecrated leader presides over a spiritually-enhanced people to be a light to the nations of the world. In such a context the father/teacher paradigm is also relevant.
The Talmud states that the honor due to a father is also due a fortiori to a teacher of Torah in that the father brings on into this world but the teacher brings him into the next.
Since all but the most extreme advocate of feminism/alternative roles etc. would agree that the position of father is not to be abolished in essence but to become less authoritarian, the monarch and hence the deity should be analogous.
Many elements in rabbinic sources present the Davidic king and G-d in a position similar to a constitutional monarch. The king (executive) governs in consultation with the Sanhedrin (judicial/legislative), High Priest and prophet according to the Torah (constitution) which he keeps with him at all times.
G-d governs with the Torah as blueprint for creation, consults first with the heavenly host ("let us make man") and later with righteous prophets (Abraham, Moses, etc.) and finally culminating in the doctrine that the Torah is not in the heavens, meaning that once revealed and handed down to man, divine intervention or prophecy may not enter into the process of legal interpretation. Unconnected thought regarding readings: For reasons of convenience in a country where English is a second language, I have a partiality for readings which are available in e-text online. This despite Mr. Sacks's claim that Tschernichovsky's Hebrew translations of the Iliad and Odyssey were the best in any language.

The major Christian bodies (e.g. the Catholic Church, the Eastern Orthodox Churches and the Protestant Churches) believe the Ten Commandments to be binding on them and would regard the Noahide laws as essentially a subset of these (though the requirement to set up courts, and the dietary regulation, are not explicit in the Ten Commandments). Some critics of the Noahide laws contend that insisting upon a basic set of moral laws is contrary to religious pluralism.
Some Christians believe that their existence implies that Jews may set up a legal system that would effectively outlaw Christianity. This is not the ruling according to the Code of Jewish law. If Christian were idolators - in the full sense - it would be forbidden to do business with them on the days before and after Sunday as well as any Christian holidays, as well as several other legal rulings would come into effect. This is not the case, however. Jewish Law holds that Christian is similar to idolatry, but not full idolatry, and may even be completely permitted for non-Jews.

Jewish scholars also by note that Jews today no longer carry out the death penalty, even within the Jewish community. Jewish law, in contemporary practice, sees the death penalty as an indicator of the seriousness of an offense; violators are not actually put to death. Most Jewish authorities believe that penalties are a detail of the Noahide Laws and that Noahides themselves must determine the details of their own laws for themselves. According to this school of thought - see N. Rakover, Law and the Noahides (1998); M. Dallen, The Rainbow Covenant (2003)- the Noahide Laws offer mankind a set of absolute values and a framework for righteousness and justice, while the detailed laws that are currently on the books of the world's states and nations are presumptively valid.

Christian opposition
The major Christian bodies (e.g. the Catholic Church, the Eastern Orthodox Churches and the Protestant Churches) believe the Ten Commandments to be binding on them and would regard the Noahide laws as essentially a subset of these (though the requirement to set up courts, and the dietary regulation, are not explicit in the Ten Commandments). Some critics of the Noahide laws contend that insisting upon a basic set of moral laws is contrary to religious pluralism.
Some Christians believe that their existence implies that Jews may set up a legal system that would effectively outlaw Christianity. Based on the out-of-context claims that the "all Christians are idolators", and "punishment for idolatry is the death penalty", and that "the Rabbis have absolute control and authority over Noahides", some Christian groups has generated a lot of noise against the Noahide community.

Judaism makes laws and customs for its own members (like all faiths) and does not set up governments to force Jewish beliefs on non-Jews; in contrast, some non-Jewish faiths have carried out such actions in practice.

This is not the ruling according to the Code of Jewish law. If Christian were idolators - in the full sense - it would be forbidden to do business with them on the days before and after Sunday as well as any Christian holidays, as well as several other legal rulings would come into effect. This is not the case, however. Jewish Law holds that Christian is similar to idolatry, but not full idolatry, and may even be completely permitted for non-Jews.

Jewish scholars also by note that Jews today no longer carry out the death penalty, even within the Jewish community. Jewish law, in contemporary practice, sees the death penalty as an indicator of the seriousness of an offense; violators are not actually put to death. Most Jewish authorities believe that penalties are a detail of the Noahide Laws and that Noahides themselves must determine the details of their own laws for themselves. According to this school of thought - see N. Rakover, Law and the Noahides (1998); M. Dallen, The Rainbow Covenant (2003)- the Noahide Laws offer mankind a set of absolute values and a framework for righteousness and justice, while the detailed laws that are currently on the books of the world's states and nations are presumptively valid.
